The legal battle over a ballot proposal that would allow three casinos to operate in Nebraska has begun.
Supporters of the initiative petition to put the three-part plan on the November ballot filed a promised lawsuit after Secretary of State John Gale said the Nebraska constitution barred the proposal from voter consideration.
Regardless of any decision by Lancaster County District Court, the case is likely to be appealed to the state Supreme Court.
Gale concluded the plan was disqualified from consideration because of a constitutional provision that prohibits initiatives that are basically the same from appearing on the ballot more than once every three years.
Proponents of the plan, which would allow a casino in each of the state’s three congressional districts, say it is substantially different from one defeated by voters in 2004.
