DOVER- A Kent County jury found former Delaware gubernatorial candidate Frank R. Infante Jr. guilty Wednesday on illegal gambling charges stemming from the confiscation of three slot machines from his Smyrna bar.
The Kent County Court of Common Pleas jury also found Infante Enterprises Inc., T/A Bulldozer's Saloon, guilty of the same offenses by the jury.
In March, agents with the state Division of Alcohol and Tobacco Enforcement executed a search warrant at Infante's establishment, Bulldozers Saloon, after agents received illegal cash pay outs on the machines. Under state law, slot machines may be operated legally only at the state's three licensed casinos.
The charges for which Infante and the business were found guilty of included one count of being concerned in the keeping or interest of a gambling device; three counts of possessing a gambling device and one count of providing a premise for gambling.
Administrative charges against the liquor license are also pending and will be taken before the Delaware Alcoholic Beverage Control Commissioner. Administrative penalties range from a fine to a suspension or revocation of the liquor license.
In 2004, Infante, 39, of Smyrna ran for governor on both the Independent and Libertarian party tickets.
Formal sentencing for Infante on the above charges will be at a later date before the Kent County Court of Common Pleas.
