LINCOLN, Neb. -- A proposal to legalize casino gambling in Nebraska will not appear on the November ballot.
The Nebraska Supreme Court ruled on Friday morning to overturn a lower court's decision to allow the measure on the ballot.
The ruling overturned Lancaster County District Judge Karen Flowers' decision. She had said the casino petition did not violate the state constitution's limit on submitting similar ballot proposals more than once in three years.
Nebraskans voted down two casino plans in November 2004.
Secretary of State John Gale appealed Flowers' ruling, arguing that the 2006 measure was essentially the same as the 2004 measures.
Attorney General Jon Bruning appealed the lower court ruling. In a statement released on Friday, Bruning said he is please by the ruling and is "grateful Nebraskans are spared from voting on the same issue they voted down just two years ago." |
