The Nebraska Supreme Court will hear arguments on whether a ballot initiative to legalize up to three casinos in Nebraska can appear on the November ballot.
Oral arguments in the case will begin Sept. 8, according to the court clerk’s office.
Lancaster County District Judge Karen Flowers ruled Thursday that the petition does not violate the state constitution’s limit on submitting similar ballot proposals more than once in three years. She ordered the secretary of state to start verifying signatures on the petitions and forward the initiative to the attorney general for ballot preparation.
But Attorney General Jon Bruning immediately appealed the ruling.
The package of three petitions would allow one casino in each of the state’s three congressional districts.
Nebraskans voted down two casino plans in November 2004 — one touted by Las Vegas casino interests and the other by the Legislature. Even though the details of the new proposal differ from past ones, Gale considered it more of the same.
