I saw in a different forum something about home games (poker I assume) with money changing hands being illegal...

In the US? Does anyone know the facts?

Yes home games were mentioned earlier... in the Home Games category. I know the site doesn't have a category for every gambling topic *yet* but let us try to keep the threads organized by posting the messages with topics that do exist in their appropriate forum.

That said.... I believe it has to do with whether the game is house-banked. If there is a rake or a profit being made by the host or other person, then betting at these home games is illegal.

I imagine it also varies state to state in America, so check with local authorities.

I wish that home games were legal here. I mean, sometime controversy can be caused, but that is just life. If you don't trust the people, don't play with them.

I poked around a little cuz I got curious and it appears that some cities and even states here in the US have not so keen laws. Most (and I use that word loosely) states here seem to say it's okay (a home poker game) as long as there is no party profiting off of the game in any other way than participating and winning. This means a house game can't in these cases pay a dealer, wait staff, sell food...the kind of things that don't usually happen when you go down the street to your buddy's house for the regular wednesday night game.

I think in general a home game will be left alone unless it creates some kind of disturbance or...just plain bad luck. Fortunately, (knocks on wood) I have not had the misfortune of dealing with this situation first hand.

A lot of info turned up with a simple search, seems a lot of people have had this question pop up before.

The laws are as different as they are abundant. These kinds of issues appear to be handled at the state and city level, so that's where you see your differences. Each city, state or whatever is different.

If you care, you should find out what the deal is in your neck of the woods.

I am located in Nebraska, and I was wondering if anyone knew if home gambling was legal here. I don't want to be caught by the law and get fined or something for something I wasn't sure about being illegal. I tried looking on the web for some ideas to see if it was illegal here or not, but couldn't find any results.

Ah, alright than. Thanks for that. Just have to make sure that I follow by the rules, and I wont be prosecuted in any way As long as I don't get in any trouble, I am happy with whatever goes on.

Here in the US, the legality of playing cards at home doesn't seem to be much of an issue. I think this is assuming it is in fact just a game at home with friends and such. A full on poker room that was raking the pot to pay the bills or charging a fee to play...this is when the authorities want to step in.

And why would they want to step in? You may ask yourself this at this time...

..."They" want a piece of the action, that's all.
