Official Rules

1. MOTORCITY CASINO RESERVES THE RIGHT TO MODIFY OR CANCEL THIS PROMOTION AT ANY TIME FOR ANY REASON, WITHOUT PRIOR NOTICE. MotorCity Casino’s Promotion entitled “MOTORCITY CASINO’S JACKPOTS IN SEPTEMBER PROMOTION” (the “Promotion”) begins at 10:00 am and concludes at 2:30 pm on Saturday, September 22, 2007.

2. Individuals must be 21 years of age or older to enter the casino and to participate in the Promotion. No individual may participate in the Promotion unless he/she is a current member of MotorCity Casino’s Club Metro (“Club Metro Member”) and is using his/her own current and valid Club Metro card (“Authorized Card”). Club Metro rules are posted on MotorCity Casino’s website and are available at the Club Metro booths located on the first and second floors of MotorCity Casino. Individuals who are not yet members of Club Metro may join Club Metro by making a request to do so at either of those Club Metro booths. Membership is free; no purchase is necessary.

3. During each Card Swipe Period (from 10:00 am until 2:30 pm on each Promotion Day), each Club Metro Member will have one (1) opportunity to swipe his/her Authorized Card at one of the various participating kiosks (the “Promotion Kiosks”) located in the Club Metro area (or such other on-premises location as MotorCity Casino designates by verbal or written notice in the casino) for the opportunity to win a Prize (as described below) generated using MotorCity Casino’s electronic Random Number Generator (“RNG”). Each Club Metro Member who swipes his/her Authorized Card in accordance with these Rules will win a Prize. The following Prizes will be available for award during each Card Swipe Period: (i) a maximum of nine hundred and fifty (950) Prizes consisting of $5 of Reward Play (each a “$5 Reward Play Prize”), (ii) a maximum of forty-five (45) Prizes consisting of $10 of Reward Play (each a “$10 Reward Play Prize”), (iii) a maximum of fifty (50) Prizes consisting of $15 of Reward Play (each a “$15 Reward Play Prize”), (iv) a maximum of eight (8) Prizes consisting of $20 of Reward Play (each a “$20 Reward Play Prize”), (v) a maximum of eight (8) Prizes consisting of $30 of Reward Play (each a “$30 Reward Play Prize”), (vi) a maximum of seven (7) Prizes consisting of $40 of Reward Play (each a “$40 Reward Play Prize”), (vii) a maximum of seven (7) Prizes consisting of $50 of Reward Play (each a “$50 Reward Play Prize”), (viii) a maximum of six (6) Prizes consisting of $60 of Reward Play (each a “$60 Reward Play Prize”), (ix) a maximum of six (6) Prizes consisting of $70 of Reward Play (each a “$70 Reward Play Prize”), (x) a maximum of five (5) Prizes consisting of $80 of Reward Play (each an “$80 Reward Play Prize”), (xi) a maximum of five (5) Prizes consisting of $90 of Reward Play (each a “$90 Reward Play Prize”), (xii) a maximum of five (5) Prizes consisting of $100 in Cash (each a “$100 Cash Prize”), (xiii) a maximum of two (2) Prizes consisting of $250 in Cash (each a “$250 Cash Prize”), (xiv) a maximum of two (2) Prizes consisting of $500 in Cash (each a “$500 Cash Prize”), and (xv) a sufficient number of Prizes consisting of $2 of Reward Play (each a “$2 Reward Play Prize”) to award one $2 Reward Play Prize to each Club Metro Member who swipes his/her Authorized Card in accordance with these Rules and does not win one of the Prizes described in subsections (i) through (xiv) above. MotorCity Casino reserves the right (but has no obligation) to modify the Prizes awarded in the Promotion to add one or more new Prizes or change any Prizes in its sole election.

4. To participate in the Promotion, the Club Metro Member must personally appear in the Club Metro area (or such other on-premises location as MotorCity Casino designates by verbal or written notice in the casino) during a Card Swipe Period to swipe his/her Authorized Card at a participating Promotion Kiosk (each such action being elsewhere in these Rules referred to as a “Swipe”). Each Club Metro Member may Swipe his/her Authorized Card only once during each Card Swipe Period. Upon Swiping his/her Authorized Card, the Promotion Kiosk display will indicate which one of the Prizes the Club Metro Member has won. After the Promotion Kiosk displays the Prize, that Prize will be provided to the Prize winner, subject to and in compliance with the balance of these Rules. Prizes won must be claimed and received during the applicable Card Swipe Period; otherwise, they will be deemed void and forfeited.

5. It is the responsibility of each Club Metro Member participating in the Promotion to make sure he/she is using his/her Authorized Card and that the card is working properly. If a card is not working properly, a duplicate card may be obtained free of charge at any Club Metro booth in the casino.

6. Each Card Swipe Period will conclude exactly at 2:30 pm. Any Club Metro Member who has not Swiped prior to 2:30 pm will not be permitted to Swipe after 2:30 pm , even is he/she is waiting in line to Swipe at the 2:30 pm conclusion of the Card Swipe Period.

7. Odds of winning a Prize cannot be predicted by MotorCity Casino because those odds depend on a number of factors, including the number of individuals who choose to participate in the Promotion.

8. COMPUTER, MECHANICAL, OR POWER PROBLEMS MAY SOMETIMES PREVENT THE RNG, A PROMOTION KIOSK OR AUTHORIZED CARD FROM PARTICIPATING IN THE PROMOTION; IN THAT CASE, A PARTICIPANT MAY NOT BE ABLE TO WIN A PRIZE. For example, if a Promotion Kiosk fails to read an Authorized Card or a Promotion Kiosk display indicates that the Promotion Kiosk is temporarily out of service or that there was an error processing a Swipe, such computer, mechanical or power problems may exist. If a participant thinks his/her Authorized Card or the RNG or a Promotion Kiosk or its display is not working properly the participant may notify a Club Metro representative or any MotorCity Casino personnel attending the Promotion Kiosk.

9. If a Club Metro Member is the winner of any “Cash Prize,” in order to receive his/her “Cash Prize,” he/she must present to the MotorCity Casino management attending the Promotion Kiosk(s) his/her Authorized Card plus his/her current and valid driver’s license or other government-issued identification card containing his/her photograph and the same name as is on his/her Club Metro Account, and which identification is otherwise acceptable to MotorCity Casino in its sole discretion (“Government ID”).

10. The Prizes will only be distributed by authorized MotorCity Casino management personnel. The Prizes available in this Promotion will only be awarded and distributed subject to and in compliance with these Rules. All Prizes available in this Promotion must be accepted exactly as awarded, and none may be assigned or otherwise transferred.

11. MotorCity Casino has no obligation to post winning Prize information on its website or to give out such information by telephone, fax or mail (of any type), or any other means of communication, but may do so in its sole discretion. MotorCity Casino may in its sole discretion broadcast winning Prize information over its audio equipment or on its plasma screens. Swipes conducted with Club Metro cards obtained or used in violation of these Rules or Swipes conducted with Club Metro cards that have been altered, forged, counterfeited, reproduced, stolen, mutilated or tampered with in any way or Swipes otherwise improperly conducted are void; MotorCity Casino assumes no responsibility for such cards or Swipes. MotorCity Casino reserves the right in its sole discretion to subject the winning of Prizes in this Promotion to a verification process. Good faith efforts will be made to complete the verification process as soon as reasonably possible. At the sole discretion of MotorCity Casino an individual will not be a “winner” until the verification process has been completed and MotorCity Casino management is satisfied in its sole discretion that the individual is entitled under these Rules to the applicable Prize; if MotorCity Casino is not so satisfied, the individual will be deemed to have forfeited the applicable Prize. The individual must also, upon request, sign such documentation as MotorCity Casino requires with respect to accepting a Prize, including without limitation MotorCity Casino’s Acceptance of Award form; anyone who fails to sign that form upon request shall be deemed to have forfeited the applicable Prize. Acceptance of any Prize constitutes that winner’s permission for MotorCity Casino and its affiliates and designees to use his/her likeness, first name and hometown for publicity or promotional uses without compensation.

12. This Promotion is subject to all applicable federal, state and local laws, rules, and regulations. All references to the value of any Prize are in U.S. funds. All times stated in this Promotion are local Detroit, Michigan times. All applicable federal, state and local taxes, as well as fees and licenses, are the sole responsibility of the winner, who must pay all applicable taxes on Prizes won and must, if requested by MotorCity Casino, authorize the deduction of all applicable taxes. Residents of states of the United States and provinces of Canada that prohibit participation in promotions of this nature are not eligible to participate in this Promotion. No purchase is necessary to participate in this Promotion.

13. Individuals who have elected to become “disassociated persons” pursuant to the Michigan Gaming Control and Revenue Act are prohibited by law from entering the casino and thus will be deemed to have forfeited any Prize won. MotorCity Casino associates are prohibited from winning any Prize and will be deemed to have forfeited any such Prize won. IMMEDIATE FAMILY MEMBERS (AS DEFINED BELOW) OF MOTORCITY CASINO ASSOCIATES MAY PARTICIPATE IN THE PROMOTION BUT ARE PROHIBITED FROM WINNING ANY CASH PRIZE AND WILL BE DEEMED TO HAVE FORFEITED SAME. The following persons are also prohibited from winning any Prize(s) and will be deemed to have forfeited any such Prize(s) won: Members of the Michigan Gaming Control Board, its staff, state police gaming section employees and employees of the attorney general assigned to the casino control division; owners of MotorCity Casino; vendors providing gaming or associated equipment to MotorCity Casino; and to the extent their participation is contrary to law, the immediate family members of the foregoing. Immediate family means any of the following, whether by the whole or half blood, marriage, adoption or natural relationship or effect of law: spouse (other than a spouse who is legally separated from the individual under a decree of divorce or separate maintenance) and, also, each parent, father-in-law, mother-in-law, grandparent, sibling, dependent, child, and grandchild, as well as the spouse of each of the foregoing.

14. MotorCity Casino reserves to itself the right to interpret these Rules and to resolve any dispute or situation not covered by these Rules in such manner as it deems fair and appropriate in its sole and absolute discretion, and each such decision shall be final and binding on all participants, subject to the requirements imposed by the Michigan Gaming Control Board. To apprise MotorCity Casino of a dispute, a participant must provide written notice in person or delivered by nationally recognized overnight courier service or certified mail to MotorCity Casino’s Director of Compliance at 1922 Cass, Detroit, MI 48226. The notice must be accompanied by a detailed written description of the basis for the dispute and must be so provided within ten (10) days of the date of the incident giving rise to the dispute. MotorCity Casino reserves the right to disqualify from participation in the Promotion any individual who violates any of the Rules of the Promotion or attempts in any way to defraud MotorCity Casino or any of its patrons, and anyone so disqualified will be deemed to have forfeited his/her right to win any Prize and may be subject to criminal prosecution. In addition, MotorCity Casino reserves the right in its sole discretion to void any Swipe and/or to change, cancel, suspend or modify the Promotion at any time for any reason, without notice, including, without limitation of the foregoing, in the event that the Promotion is not capable of being conducted or continued as planned (e.g., due to computer virus, tampering, unauthorized intervention, fraud, technical failure, or any cause which MotorCity Casino in its sole discretion concludes affects the administration, security, fairness, integrity or proper conduct of this Promotion) or in the event that it is impractical to conduct or continue all or part of the Promotion as a result of construction activity or events beyond the control of MotorCity Casino (including, without limitation of the foregoing, acts of terrorism, civil commotion, war, fire, explosion, inclement weather or other Acts of God, power failure, or labor unrest of any type). MotorCity Casino is not responsible for any errors or omissions in any advertising for this Promotion. The Promotion Rules are available in the casino and copies will be mailed upon specific written request, provided a self-addressed, stamped envelope accompanies each request. MotorCity Casino is not responsible for any incomplete, lost, late, damaged, illegible or misdirected mail or failure of the postal service to deliver the mail in a timely manner.

15. Performing a Swipe or requesting an opportunity to Swipe, accepting a Prize, or otherwise participating in the Promotion, is an agreement to abide by the Rules of the Promotion as amended from time to time and constitutes the participant’s agreement to release MotorCity Casino, as well as its respective parents, subsidiaries, members, affiliates, advertising agencies, promotion agencies, and Prize suppliers, and their respective officers, directors, agents and employees, as well as their respective successors, representatives, and assigns from any and all actions, claims, injuries, losses, damage, and liability arising in any manner, direct or indirect, from participation in the Promotion or acceptance of any Prize.

16. MOTORCITY CASINO RESERVES THE RIGHT IN ITS SOLE DISCRETION TO TREAT AS FORFEITED ANY PRIZE AWARDED TO AN INDIVIDUAL WHO DOES NOT COMPLY WITH ANY ONE OR MORE OF THESE RULES REGARDING THIS PROMOTION (INCLUDING ANY INDIVIDUAL WHO IMPROPERLY USES OR SWIPES A CLUB METRO CARD).

17. MotorCity Casino may, in its sole discretion, elect to extend or re-run this Promotion on one or more occasions, in which case it may change the location of the “Promotion Kiosks” and/or the name, the duration, the Prize structure, the weekdays and/or the times of the Promotion and make such modifications to the Rules as would be appropriate in connection with those changes. In such event, MotorCity Casino will post signage in the casino or take such other measures as it deems appropriate to notify patrons of such election.

MotorCity Casino’s promotion entitled “MotorCity Casino’s Pick Any Card Promotion” (the “Promotion”) begins at 2:00 p.m. on the first day of a Promotion Period and concludes once all Prize(s) (as elsewhere herein defined) have been awarded on the final day of the Promotion.

During the Promotion: Session I: begins September 24, 2007, and concludes September 26, 2007 (the “First Promotion Period”), Session II: begins October 22, 2007, and concludes October 24, 2007 (the “Second Promotion Period”), Session III: begins November 19, 2007, and concludes November 21, 2007 (the “Third Promotion Period”).

Individuals must be 21 years of age or older to enter the casino and to participate in the Promotion. In this Promotion, MotorCity Casino’s Club Metro Members will have the opportunity to win a Cash Prize (each a “Cash Prize”) eligible for EACH Promotion Period’s twelve (12) drawings (each a “Drawing”) that will be held at MotorCity Casino in the Chromatics Lounge area (or such other on-premises location as MotorCity Casino designates by providing verbal or written notice in the casino in advance of that Drawing) (the “Promotion Area”) at approximately 2:00 p.m., 4:00 p.m., 6:00 p.m. and 8:00 p.m. each Tuesday and Wednesday (on September 24th, September 25th, September 26th, October 22nd, October 23rd, October 24th, November 19th, November 20th, and November 21st) during EACH Promotion Period. At each Drawing, a Drawing Drum containing ten (10) balls will be displayed in the Promotion Area. Each ball in the Drawing Drum will be marked with one (1) one-digit number, from “0” (zero), through “9” (nine), inclusive. During each Drawing, three numbered balls, one at a time, will be drawn from the Drawing Drum by an individual appointed by the MotorCity Casino Drawing host(s). After the first ball has been drawn and the number on it has been recorded, that ball will be returned to the Drawing Drum and a second ball will be drawn from the Drawing Drum and the number on the second ball will be recorded, and then that ball will be returned to the Drawing Drum and a third ball will be drawn from the Drawing Drum. The number on the third ball will be recorded. After the three (3) one-digit numbers have been recorded, they will be combined to make a three-digit number, with the first number drawn being the first digit of the three-digit number, the second number drawn being the second of the three-digit number, and the third number drawn being the third of the three-digit number. The three-digit number associated with that specific Drawing will be announced by the Promotion representative(s) a minimum of three (3) times. Any MotorCity Casino Club Metro Member that holds ANY eligible club card from a casino within Michigan’s Wayne County or Ontario’s Essex County whose LAST three (3) OR two (2) sequential numbers of their Club Metro account numbers match in exact sequence the winning two-digit number from that specific Drawing will win a Cash Prize. For each Drawing during the Promotion Period the winner of an Opportunity Prize must be “present” to win and will be regarded as “present” only if he/she appears personally in the Promotion Area and verbally identifies himself/herself to the designated Promotion representative no later than five (5) minutes following the third such announcement of the Drawing’s winning three-digit number AND also promptly presents to that Promotion representative his/her own winning eligible casino club card that has the same name as is on his/her MotorCity Casino Club Metro Account, his/her Club Metro Card plus his/her current and valid driver’s license or other government-issued identification card containing his/her photograph and the same name as is on his/her Club Metro Account, and which identification is otherwise acceptable to MotorCity Casino in its sole discretion (“Government ID”). After five (5) minutes have passed from the Promotion representative’s third announcement of the Drawing’s winning three-digit number, the Cash Prize(s) will be provided to the Cash Prize winner(s) who have appeared as described above, subject to and in compliance with the balance of these Rules. Prizes won must be claimed and received no later than five (5) minutes following the third such announcement of the Drawing’s winning three-digit number AND prompt presentation of the winner’s eligible casino club card, winner’s Club Metro Card plus his/her Government ID to the Promotion representative(s); otherwise, such Opportunity Prizes will be deemed void and forfeited.

Match three (3) sequential numbers and the cash prize is $250. Match two (2) sequential numbers and the cash prize is $25.

A winner may claim only one cash prize per drawing.

Odds of being a winner in a Drawing cannot be predicted by MotorCity Casino because those odds depend on a number of factors, including the number of Club Metro members present, the number of eligible and matching Club Metro account numbers, etc.

MotorCity Casino is not responsible for any false awards or for incorrect or inaccurate information disseminated by Promotion Participant(s) or due to equipment or programming error or malfunction, nor is MotorCity Casino responsible for Prizes that might have been earned absent computer or equipment malfunction. MotorCity Casino reserves the right in its sole discretion to subject the winning of Prizes in this Promotion to a verification process. Good faith efforts will be made to complete the verification process as soon as reasonably possible.
