An article by Charlotte Observer reporter Jim Morrill in the Aug. 12 State about my wife and I seeking a new life in Florida failed to mention some key points in the Republican U.S. attorney’s office prosecution — items that even prosecutors agree with in their pre-trial filings with the court:

I never accepted or solicited a bribe while serving as a volunteer on the N.C. Lottery Commission.

I did nothing to steer a contract to Scientific Games or any other lottery vendor and actually recused myself from voting on any contract benefiting any lottery vendor during the very first lottery board meeting.

I did not secure a job with the lottery for any relative, friend or past business associate.

I did nothing improper or unethical during my five weeks as a lottery commissioner and actually was hailed as an effective commissioner by my colleagues.

The state of North Carolina found nothing “illegal” about the financial interest form I downloaded from the Internet and submitted. Only Republican federal prosecutors determined to snag Democrat Jim Black see potential illegality in my form filing.

I have absolutely no criminal violations in my past and served for years in and out of state and federal government with distinction.

It’s hard to see this in all the negative publicity I have garnered since last September, but I did indeed disclose my relationship with Scientific Games on the ethics form in question and during my first Lottery Commission meeting. However, I admit to making a stupid media relations mistake by not giving the press extensive details about my company’s past business relationship with Scientific Games. I should have attached confidential company invoices, etc., to the “form” in question and worked to release confidential company invoices to the media. That was a mistake, but not a violation of the law. I believe an impartial jury will carefully consider the evidence beyond the negative newspaper coverage I have received in the Carolinas and will find me innocent.
