I think your question is a good one, but dangerous for many to answer. In short it's legal advice you are looking for.
The answer seems to be that it's really unclear - but, let's look at some facts though. Your letter seems to be just about right. The law seems to be directed at the financial transaction companies handling the gamblers money - not at the gambler him or herself.
According to the WTO it seems that America is wrong. It keeps losing its case with Antigua a small country who is claiming in the World Trade courts that America is interfering with its free trade.... and, Antigua keeps winning!
Gambling in Virginia for real money is probably illegal. I think that's the case in a lot of states if not MOST. The way everyone gets away with it seems to me because the gambling does not occur in Virginia actually: it occurs wherever the casino is licensed and has its servers located. [like Antigua] This is how online gambling ever got to be as mainstream to begin with as it is.
