Ontario moves to end illegal Web gambling

Ontario is looking to quash Internet gambling by introducing a bill today that will ban such Web sites from advertising, a move legal experts say oversteps the province's authority.

Gerry Phillips, Minister of Government Services, will table a bill of amendments to Ontario's Consumer Protection Act, including a section aimed at banning media organizations from running ads by gambling Web sites.

The primary driver behind the legislation is the dramatic rise in Internet gambling addiction among teenagers, according to ministry spokesman Paul de Zara. A recent survey by the Responsible Gambling Council found that addiction among people aged 18 to 24 rose 400% between 2001 and 2005.

"The addiction rates for children are pretty startling," Mr. de Zara said.

The legislation is only targeting illegal sites -- namely those that take money bets -- and will exclude "for-fun" sites. Mr. de Zara said all Web sites that take money bets from Canadians are illegal under the Criminal Code because the provinces have exclusive authority over all forms of gambling.

"You can't advertise something that is illegal," he said. "We don't let drug dealers advertise crack houses."

Mr. de Zara said the government's secondary motivation was to stem the outflow of gambling money from the coffers of provincially approved, taxed and regulated organizations to Web sites that are generally not based in Canada.

The legislation is based on a similar private member's bill introduced by MPP Jeff Leal this year, which was supported by Woodbine Racetrack, and follows a major U.S. crackdown on Internet gambling last month. The U.S. Congress passed a bill banning financial institutions and credit card companies from taking payments from U.S.-based bettors, effectively crippling the industry there.

Legal experts say the U.S. and Ontario actions are similar in that neither government has made Internet gambling illegal outright, but both have put a chill on the industry through indirect moves against it.

John Tuzyk, a partner at Blake, Cassels & Graydon specializing in gaming law, said Criminal Code violations are a federal matter, and Ontario's attempt to regulate online gambling through the Consumer Protection Act will add to what is already a legal grey area.

"It begs the question about whether the activity itself is illegal," he said. "They're kind of implying it's illegal, but to be convicted of breaching the [Consumer Protection Act] they would still have to show that Internet gaming is illegal, which has not been definitively established in Canada yet."

Danielle Bush, a partner at McCarthy Tetrault, which represents several large media companies, said the legislation would introduce uncertainty for those firms and put an unfair onus on them to decide which ads may or may not be illegal. She also objected to the government's stated moral purpose.

"They're overstepping their bounds somewhat," she said. "You simply can no longer say that gaming and gambling are an evil that should be eradicated. You can't take that position and continue to offer the services yourself."

British Columbia and the Atlantic provinces have legal Internet gambling in the form of lotteries and sports-betting games. European countries, with the United Kingdom in particular, are also moving in the opposite direction of North America by legalizing, regulating and taxing online gambling Web sites.

So when I break the law I'm an adult, and when I'm gambling, I'm a child? 18-24 here in the United States anyway is a consenting adult, not a child.

What will these people think of next?

Have you all seen the Jon Stewart show when they passed the port security bill with the online gambling ban attached? It is extremely funny. I watched it on youtube.com but I can't find it now or I would have posted the link.

Unless, of course, you want to buy a drink. Then 18-20 is still underage. But that's off topic.

The whole internet gambling issue is just a bunch of politicians trying to shove their ethics down our throats. I always voted republican because of their stand on abortion. But, I'm seeing that seems to be the only issue on which I agree with them anymore, so I stopped voting for them. I didn't vote for "Dubya", and I won't vote for their next candidate for president. Same with local elections. We really need some major political changes.

The whole internet gambling issue is just a bunch of politicians trying to shove their ethics down our throats. I always voted republican because of their stand on abortion. But, I'm seeing that seems to be the only issue on which I agree with them anymore, so I stopped voting for them. I didn't vote for "Dubya", and I won't vote for their next candidate for president. Same with local elections. We really need some major political changes.


I disagree - these guys don't have any morals to push down our throats; seeing as Bill Frist accepted 50,000 in contributions from a large, well known, casino corporation. This guy is a complete hypocrit. What about the carve outs in the bill for online lottery tickets and oh yeah... online horse racing? the proponents of this bill also received money from the horse racing industry.

Guys and Girls -- this is all about the money in my opinion

You won't be suprised when the U.S. all of a sudden wants to legalize online gambling again? and tax it and regulate it, right? Of course it will be all the ultra-rich and land based casinos running the game the next time around as all who are currently making a living from this industry are getting the life choked out of them right now.

I am all about voting -- PLEASE -- get out and VOTE in this election it could never be so important.

As for the other statements up there. FREEDOM and RIGHTS are the most important. If we start letting the government control us and make moral decisions for us it will never stop. Someone always feels that they know better. Precisely why you should always oppose politicians who try to impose restrictions on freedom of any measure.

Eventually the decisions they make for us will conflict with YOUR walk of life.

Take the opposite end of the abortion argument. What if you had too many children (and population is a problem in this world) and the government decided if you had more than one child that they were going to put you in a room and perform an abortiong on you? OBVIOUSLY this is why we cannot allow our personal decisions (be they good or bad) to be made by our government.

And what do the governments do to make us SAFER? Why the go to war of course. And offer us free education if we go fight it while they sit around in plush rooms and watch it on T.V. do you feel safer? And can you believe it? They take the time to make online gambling illegal. They make a mockery of our democracy.

LOL, that's so true!! But they'd like you to think they do.

I think I'd be surprised if they ever decided to legalize online gambling. They went to so much trouble to make it illegal, I just don't see them changing their minds on the issue.

I have every intention of voting, but I will not vote republican ever again. I've figured out that their anti abortion stand is probably the one point we agree on. And, Roe v. Wade is never going to be overturned, so it's really a non-issue. Time to vote for someone who isn't so anxious to go to war. Someone who knows there are bigger issues than a harmless internet poker game. Someone who truly cares about the people.
