Florida Home Poker Games

The game of poker although legal in Florida for many years, comes with restricted betting limits. Cardrooms are only allowed to operate a maximum of 12 hours a day but they are no longer required to be open only from 12:00p.m. to 12:00a.m., because of a 2003 Law giving Cardrooms the ability to choose which twelve hours. The betting rule in these Cardrooms is a maximum of $2 per round and allows single bet limits of $5. No-Limit Texas Hold’em games come with a maximum required buy-in of $100, with tournaments.

The play of home poker games seems to be getting much attention these days in the media. Florida’s Criminal Law Chapter 849 states that if you own or operate a house or room for the purpose of gambling or gaming, you are guilty of a charge in the third degree unless it involves a penny-ante game. So Penny poker is then legal at home poker games. However, the laws created to regulate home gambling does not specify home poker; and because poker has become more and more acceptable to society, many home poker game players feel that if they do get caught playing or organizing they might be not be fully punished.

Chapter 849 has a sub-section in it called Sub-Section 85 that defines the terms of a penny-ante game. It outlines that you the game cannot contain a pot of more than $10. The game cannot charge an admission or “rake” to its players by the host. It cannot be conducted in somebody’s home or advertised in advance. All players must be over the age of 18. The sub-section also states that debts incurred in penny-ante games are not legally enforceable, nor can any player or host of the game be charged in court.

Interestingly enough there are website forums that are for home poker and finding places to play near you or for gathering additional players to your home game and you can create your own home poker leagues. In reading a recent article it said that people playing poker in homes is really where it starts. More people continue to play at their kitchen tables or in recreation rooms than in public poker rooms. The article also said that it was a good thing because home players interested in poker beyond their city limits is what helps the poker industry to continue to grow. Every day people are transitioning from home poker to public poker.

Playing home poker in Florida, the main focus should be playing for fun because it is not likely you’re going to profit that much from hosting your own game. The significant point to realize is that least playing poker in Florida is legal as long as you follow the rules.
